Welcome to CircleMate (“we”, “our”, or “us”). By accessing or using circlemate.me (the “Service”), you agree to be bound by these Terms of Service (“Terms”). Please read them carefully.
1. About CircleMate
CircleMate is a web-based application operated by Marko Budal s.p., a sole proprietor registered in Slovenia, that helps Instagram users analyze their follower relationships by processing their official Instagram data exports. We do not access user accounts directly and never request Instagram login credentials. You can reach us at hello@circlemate.me.
2. Eligibility
You must be at least 13 years old to use CircleMate. By using the Service, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.
3. Account Registration
To access certain features, you may need to create an account by providing a valid email address. You are responsible for maintaining the confidentiality of your account credentials.
4. Subscription Plans and Payments
CircleMate offers the following plans:
- Free Plan: Limited features, 1 upload per month
- Pro 6 Months: €9.99 every 6 months — unlimited uploads and full features
- Pro Yearly: €14.99 per year — unlimited uploads and full features
Payments are processed by Paddle.com Market Limited, our Merchant of Record. By subscribing, you agree to Paddle's terms of service.
Subscriptions automatically renew unless cancelled before the renewal date. You can cancel anytime from your account settings or by contacting hello@circlemate.me.
We reserve the right to change our prices, introduce new plans, and modify or discontinue existing plans at any time. Price changes do not affect the current paid period of an active subscription — they apply only to future billing periods, and we will make the updated price available before it takes effect. We also reserve the right to add, change, limit, or remove features, whether free or paid, at any time.
Marko Budal s.p. is not currently a VAT payer (in accordance with Article 76.a of the Slovenian VAT Act — ZDDV-1). Paddle, as our Merchant of Record, handles applicable EU VAT for end customers.
5. Acceptable Use
You agree NOT to:
- Use CircleMate for any illegal or unauthorized purpose
- Attempt to gain unauthorized access to our systems
- Upload data that is not your own Instagram export
- Reverse engineer, decompile, or attempt to extract source code
- Use automated tools to access the Service without permission
- Resell, sublicense, or commercially redistribute the Service
6. User Data and Content
You retain ownership of any data you upload to CircleMate. By uploading your Instagram data export, you grant us permission to process it solely to provide the Service.
We do not share, sell, or distribute your uploaded data to third parties. See our Privacy Policy for full details.
7. Intellectual Property
CircleMate, including its design, code, branding, and features, is owned by Marko Budal s.p. and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without permission.
8. Copyright and IP Infringement
We respect the intellectual property rights of others and respond to valid notices of copyright infringement.
To submit a notice, email hello@circlemate.mewith the subject line “Copyright Notice” and include:
- Identification of the copyrighted work you claim has been infringed
- A description of the allegedly infringing material and where it can be found on CircleMate
- Your name, address, telephone number, and email address
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the owner's behalf
- Your physical or electronic signature
We will investigate valid notices and remove infringing content where appropriate. If you believe content was removed in error, you may submit a counter-notice in reply. Where applicable law permits, we may restore the content if the original complainant does not file a court action within 10 business days of receiving your counter-notice.
Accounts of users we determine to be repeat infringers may be suspended or terminated at our discretion.
9. Disclaimer of Warranties
CircleMate is provided “as is” and “as available”, without warranties of any kind, whether express or implied. We do not guarantee any particular level of uptime or availability, nor that the Service will be uninterrupted, timely, secure, error-free, or completely accurate — especially as Instagram's data export format may change without notice. You use the Service at your own risk and are responsible for any results or decisions based on it.
We may modify, suspend, or discontinue the Service or any of its features, in whole or in part, at any time and without prior notice or liability to you, including for maintenance, updates, or operational reasons.
10. Limitation of Liability
To the maximum extent permitted by law, Marko Budal s.p. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from or related to your use of (or inability to use) the Service. To the maximum extent permitted by law, our total aggregate liability for any claim relating to the Service shall not exceed the amount you paid us, if any, in the twelve (12) months preceding the event giving rise to the claim.
You are solely responsible for your own actions and conduct when using the Service, and for any data or content you upload, including ensuring you have the right to upload it. Nothing in these Terms limits liability that cannot be excluded under applicable mandatory law.
11. Affiliation Disclaimer
CircleMate is not affiliated with, endorsed by, or sponsored by Instagram, Inc. or Meta Platforms, Inc. Instagram is a trademark of Meta Platforms, Inc.
12. Termination
We reserve the right to suspend or terminate your account if you violate these Terms. You may delete your account at any time from your settings page.
13. Changes to Terms
We may modify these Terms from time to time to reflect product, legal, or operational changes. Where a change is material, we will notify users by email or in-app notification at least 14 days before it takes effect.
Continued use of CircleMate after a modification takes effect constitutes acceptance of the updated Terms. If you do not agree to a change, you may terminate your account before the effective date.
14. Governing Law
These Terms are governed by the laws of the Republic of Slovenia and the European Union. Any disputes will be resolved in the competent courts of Slovenia.
